Begoña Gómez makes a move following Judge Juan Carlos Peinado’s decision this Monday to conclude the investigation against her and send her case before a jury. The defense of the wife of the Prime Minister has submitted a procedural motion in which they reproach the magistrate for continuing with the procedure without having resolved one of their appeals in the case beforehand. In it, they point out that the judge is advancing the procedure in an “abnormally accelerated” manner.

“The continuation of the criminal procedure without the judicial body having resolved the appeals filed by the parties against the initiation order constitutes a violation of the fundamental right to effective judicial protection without defenselessness,” the document states. This Monday, after two years, the magistrate concluded his controversial and confusing investigation, and proposed to try Gómez for four crimes: embezzlement, influence peddling, corruption in business, and misappropriation of a brand. He also decided to prosecute the advisor at Moncloa Cristina Álvarez and the businessman Juan Carlos Barrabés.
The lawyer of the Prime Minister’s wife, Antonio Camacho, acknowledges in his document that the pending appeal does not by itself require the process to be stopped, but continuing without resolving it does cause harm to his client. The procedural motion submitted by the lawyer is a way for the parties in a procedure to ask the judge to respond to a pending request or continue with the process.
