The PSPV-PSOE has filed an appeal for protection before the Constitutional Court (TC) to try to reopen the Dana Commission in Les Corts Valencianes, according to the submitted document.

The appeal is filed specifically for violation of the fundamental right to exercise public representative office, recognized in article 23.2 of the Spanish Constitution (CE), in connection with the right of citizens to participate in public affairs through their representatives, recognized in article 23.1 CE.
The document is based on two fundamental violations. The first, the replacement of appearances before the Les Corts Investigation Commission by the incorporation of transcripts of appearances held before the Congress of Deputies Investigation Commission, “depriving the appealing deputies of the ability to ask their own questions, follow up, request clarifications, confront the witnesses with the collected documentation, and direct the interrogation towards the specific object of the investigation.”
And the second violation refers to the configuration and conclusion of the Commission’s work “in such a way that, while the exercise of the investigation and control function regarding actions and officials belonging to the Administration under the authority of the Generalitat was prevented or limited, the finally approved conclusions shifted political oversight towards the General State Administration and made explicit judgments about its responsibilities, even though the Statute of Autonomy of the Comunitat configures the parliamentary control function of Les Corts regarding the Administration under the authority of the Generalitat and allows the creation of investigation commissions to develop it.”
The appeal details “irregularities” that occurred during the Investigation Commission and the approval of the report in Les Corts, as detailed by Alicia Andújar, spokesperson for Emergencies of the socialist group in the Valencian chamber.

For this reason, the socialists demand that the violated rights be restored and that a parliamentary action “that cannot have a place in an institution that represents the voice of the Valencian people and, consequently, the memory of the 232 people who drowned” be annulled, Andújar specified.
In her opinion, “Les Corts Valencianes are there to clarify what happened and to demand accountability, and we will not allow the Popular Party and Vox to use Les Corts as a political shield to erase the responsibility of Carlos Mazón and the Ventorro Council.” “This illegal report is intolerable. We will go all the way and use all legal and parliamentary means at our disposal to ensure that this report is annulled and removed from the Les Corts Session Diary,” Andújar added.
And she added: “Against attempts to impose a version that covers up Mazón, our duty as representatives of the Valencian people is to defend the truth, the dignity of the victims, and the right of all Valencian society to know what happened and why,” she concluded.
