The Madrid Investigative Court number 8 is examining five complaints regarding the purchase of a penthouse for 6.3 million by the public company Planifica Madrid, according to a document from the Prosecutor’s Office accessed by EL PAÍS. The Prosecutor’s Office has received four documents – three from individuals and one from the PSOE – which it has sent to Court 8, which has already opened proceedings following a complaint from Iustitia Europa, a political party. The complainants believe that with the acquisition of the property where Isabel Díaz Ayuso’s office was supposedly to be temporarily installed, executed in an opaque manner, without a file or reason in Planifica Madrid’s annual budget, a series of crimes have been committed that are already under investigation by the justice system.
The four complaints thus add to the preliminary proceedings 2317/2026, according to Deputy Prosecutor José Luis García Juanes-Guerrero. The Prosecutor’s Office has deemed it necessary to combine the documentation into a single file, as in all cases the board of directors of the public company is accused regarding the purchase of a penthouse at number 35 General Martínez Campos Street. The Community of Madrid has already put the property up for sale at a value of 6.7 million, but many doubts remain to be resolved. It remains to be known who ordered the purchase, how and why that particular property was chosen, which could not be used either as an office or as a presidential residence, and above all, why the file containing the justificatory report of the operation has not appeared.
The purchase-sale was carried out with total secrecy and if this newspaper had not revealed it, it would have been untraceable. Planifica Madrid did not include it on the agenda of its website, where it instead reported on very minor matters. The Government must have approved it in a Government Council meeting – it is still unknown which one – but did not report it in the subsequent press conference, despite it being a significant acquisition. The explanations from Ayuso and the Minister of the Presidency and president of the public company, Miguel Ángel García Martín, have been insufficient. The opposition has requested the appearance of the minister before the Assembly of Madrid after Ayuso pointed to her Ministry as responsible for clearing up any doubts.

The PSOE has pointed out in its complaint the board of Planifica Madrid for possible crimes of administrative misconduct and embezzlement. In their view, there are “gaps and procedural irregularities” as these are facts affecting the public administration in relation to its assets. In addition to “the total absence of public documentation to support and clarify them, which should have been published.” The Community of Madrid, however, urges waiting for the file to be uploaded to the Transparency Portal once the sale is closed, if there is a buyer willing to pay a 400,000 euro premium after the purchase, which took place in April. The final price, 6.3 million, already includes the 189,000 euro commission taken by a luxury real estate agency, Promora, according to sources from that company. The real market value of the penthouse, measuring 485 square meters (200 of terrace), is around 6 million.
Iustitia Europea has specialized in filing complaints in courts regarding cases related to current political events. The party ran in the last European elections with little success: it obtained only 27,407 votes (0.15%). Today it has announced a complaint against Mohamed VI, King of Morocco, before the International Criminal Court regarding the massive entry of irregular immigrants into Ceuta, which caused a humanitarian crisis resulting in 141 deaths. The individuals who have reported the purchase of the penthouse have been identified by the Prosecutor’s Office as Jabonero Osorio, Iván de Ángel de Diego, and Dionisio Cabeza.
