September, will month: how much it costs in each State and how to carry out the procedure

September is the Will Month in Mexico. During this period, people can carry out this procedure with preferential costs, legal advice, and extended hours at notaries across the country.

The campaign began in 2003 as an initiative of the Ministry of the Interior (Segob) and the Mexican Notariat to promote a culture of foresight and facilitate that people establish their will regarding their assets and rights.

How much does it cost to make a will in Mexico: price by State

The Government of Mexico does not set a single national rate for the will. During the September campaign, preferential costs are offered, but these depend on the agreements reached in each State with the local notariat. For example, this year Chiapas has the lowest published cost, with 1,000 pesos, while Nayarit reaches 4,100 pesos for notarial fees. In other cases, such as Aguascalientes, the College of Notaries will donate 400 wills for people in vulnerable situations, especially the elderly.

How to make a will?

The procedure begins with the choice of a notary, which can be found in the country’s notary directory.

The process generally consists of going before the notary and expressing the will regarding the distribution of assets and rights. It is not necessary for the person to draft the document beforehand: the notary is responsible for giving legal form to the instructions received and then reads the content so that the testator confirms it corresponds with their will.

To start the procedure, it is advisable to bring a valid official ID and be clear about the people you wish to benefit. It is also convenient to think beforehand about who could serve as executor, that is, the person responsible for fulfilling the provisions established in the will.

Who can make a will?

The will is not reserved for people with large estates. Any adult can grant it, regardless of the size or value of their assets. The document can establish what will happen to the assets and rights a person has at the time of their death. The will allows clear instructions to be left about who will be the heirs or legatees and avoids the distribution of the estate being subject exclusively to the succession procedure provided by law.

What happens if a person dies without a will?

When someone dies without having left a will, an intestate succession is opened. In these cases, the distribution of assets is carried out according to the rules established by the applicable legislation and it may be necessary to initiate a succession procedure.

The lack of a will can generate conflicts among family members, as well as legal processes and expenses related to the succession. That is why the authorities present the document as a foresight tool that allows the person’s will to be established and facilitates the transfer of their assets.

The objective of the national campaign is precisely to reduce these situations and promote that families have greater legal certainty. Last year, according to the Ministry of the Interior, the campaign allowed 145,461 wills to be granted with discounts, extended hours, and professional advice from the Notariat.
