The Electoral Tribunal of the Federal Judiciary (TEPJF) has confirmed that Somos México, a recently created party, must change its name, emblem, and graphic elements before August 31, considering that the verb ‘somos’ (we are) in combination with the word ‘México’ “generates an effect of symbolic appropriation of collective national identity.” The Tribunal’s blow to the party that emerged from the ‘marea rosa’ (pink tide) movement will be responded to tomorrow, Thursday, when its leaders make public its new name and identity.

The controversy began in the National Electoral Institute (INE), where the councilors approved the registration of the new party in June, but ordered it to change its name (“Somos México”), its emblem (“Somos Mx”), and its Mexican pink color, which identified the citizens who between 2022 and 2024 demonstrated against the electoral reforms with which the Government sought to modify the functioning of the INE. The resolution was challenged by Somos before the Electoral Tribunal, arguing that the councilors introduced restrictions not provided for in the law: semantic neutrality and symbolic appropriation of the nation.
“The INE’s interpretation is arbitrary and restrictive, since its motivation is based on speculative inferences and not on objective elements, in addition to applying a stricter standard than to other parties with similar names and emblems, which deviates from previous criteria and jurisdictional precedents that allow the use of the word Mexico when sufficient differentiating elements exist,” argued the new organization, which obtained its registration in June.

The Tribunal has dismissed these arguments this Wednesday and confirmed the INE’s decision, so Somos has until Monday, August 31, to comply with the ruling. Somos leaders have reported that they will comply under protest and will deliver their new name, emblem, and graphic identity to the electoral authority tomorrow.
The presiding magistrate of the Tribunal, Gilberto Bátiz García, defended his draft ruling, arguing that the law requires that the integral meaning of a party’s name allow for “sufficiently characterizing and individualizing the organization as a particular option within democratic plurality.” Magistrate Reyes Rodríguez has spoken out against the resolution, as it is based on fallacious arguments, includes criteria not provided for in the laws, restricts freedoms, and does not maximize citizens’ rights. However, the rest of the magistrates supported Bátiz, and the ruling was approved by majority, with the absence of Magistrate Mónica Soto, who two weeks ago announced her separation from office.
